Now U.S. District Judge Henry Hudson is asking tough questions about the federal health-care law. Presiding over a hearing in Richmond, Va., Hudson sounded like U.S. District Judge Roger Vinson as he sparred Monday with government attorneys on the constitutionality of Obamacare. Questioning Washington's legal right to require citizens to purchase insurance, Hudson said the law's "individual mandate" could open the door for the federal government to require residents to buy a car, join a gym and "eat asparagus." "It's boundless," he said.

National Review Online is attempting to clear up a confusion created by Charlie Crist. In an article Monday, NRO quotes former Labor Secretary Robert Reich as denying he ever supported Crist's amnesty plan to "save" Social Security. Ive said well have to increase legal immigration in order to secure the Social Security of boomers (otherwise, the ratio of working population to retirees gets too far out of whack), but dont recall saying anything more, Reich stated in an e-mail.

President Barack Obama's approval ratings in Florida are bad and getting worse. Today's Sunshine State News Poll out of the 2nd Congressional District shows 59 percent of voters there disapprove of the job Obama is doing. And that's in a district with a Democratic majority.

Until now he's kept his distance from celebrity conservative Sarah Palin, but Marco Rubio, the Republican candidate who leads in the U.S. Senate race by a country mile, apparently sees a benefit in joining the sometimes popular, sometimes controversial former Alaska governor on a tea party stage. Wolf Blitzer, host of "Situation Room," told his CNN audience Monday evening that, double-digit lead or not, Rubio still sees independent Charlie Crist over his shoulder.

The Democratic gubernatorial candidate's campaign pledges will cost the average Florida household $1,789 in higher taxes, Republican leaders charged today. Following up on incoming Senate President Mike Haridopolos' written request for Sink to detail her economic policies, GOP legislative leaders calculated that the Democrat's proposals for public-sector raises and a new passenger regional rail system would cost $12.5 billion.

Republican congressional candidate Daniel Webster said he raised $577,000 during the reporting period ending Sept. 30. Collecting a total of $922,567, Webster has $399,490 cash on hand after expenses. Though he's up in the polls, the former state senator continues to trail Rep. Alan Grayson in the fund-raising race. The Orlando Democrat reported $1.2 million in cash on hand after raising a total of $4.8 million. Befitting his big-spending ways, Grayson also claims a much bigger campaign debt -- $985,966 vs. Webster's $19,321.

Lawyers for former Republican Party of Florida Chairman Jim Greer cancelled the depositions of State Rep. Dean Cannon, R-Winter Park, and Sen. Mike Haridopolos, R-Merritt Island. The legislators were scheduled to give testimony Monday regarding a contentious severance package for Greer, who is currently under a grand jury indictment for grand theft, organized fraud and money laundering, for essentially embezzling RPOF funds.

Florida and 19 other states cleared an early court hurdle last week in their fight against the federal health-care law. But attorney general candidate Dan Gelber isn't applauding. Like many Democrats who support Obamacare, Gelber has called the challenge frivolous and without constitutional basis. U.S. District Judge Roger Vinson thinks otherwise, writing in his 65-page ruling: "This is not even a close call. ... The power that the individual mandate seeks to harness is simply without prior precedent."

Pardon Democratic gubernatorial candidate Alex Sink if she's not rooting for Florida to win its federal case against Obamacare. She has money on the other side. Among her campaign contributors is Guy Burns, who gave her $1,500. Burns is one of the primary lawyers defending the Obama administration. It's difficult to believe that Sink could be bought for a measly $1,500. But, as a loyal Democrat, she's philosophically aligned with federal mandates -- even one that dubiously requires individuals to purchase insurance via tax or penalty.

Never mind that the impending tightening of class-size reduction standards puts Florida schools in an even more restrictive fiscal strait-jacket. Never mind that research fails to conclusively connect smaller class sizes with higher academic achievement -- even after Florida taxpayers have spent more than $14 billion to lower class-size formulas. The Florida PTA wants to keep throwing money into the class-size maw. Why? Because the Florida Education Association says so.
