George Pataki's Group Files Health Care Challenge

While more attention has been paid to the legal challenge launched by Florida against the federal health care law, which more than 20 states have joined in to support, Virginia has also filed its own lawsuit against the measure. Revere America, a group with ties to former Gov. George Pataki of New York, filed an amicus curiae brief in support of Virginia on Tuesday. Pataki, who is contemplating running for the Republican presidential nomination in 2012, has led petitioning efforts for Revere America to repeal the health care law.

Although the Constitution gives Congress the power to regulate interstate commercial activity, with this new law Congress claims for itself the power to regulate economic inactivity, said Charles Cooper, Revere Americas attorney. The new law takes individuals who have chosen not to engage in commerce and forces them to enter the marketplace and buy government-prescribed health insurance whether they want it or not.

Revere America continues to work diligently on many fronts to advance efforts in Congress and in the courts to end and find replacements for the federal health law passed last year, said Marianne Zuk, who is the president and CEO of Revere America. This filing adds new arguments to the long list of reasons why the health law should be repealed and replaced. We remain dedicated to advancing common-sense public policies rooted in Americas traditions of individual freedom and free markets.
