Gary Bauer Attacks Bill Nelson's Plan on Health Care Case
Conservative leader Gary Bauer, best known for leading the Family Research Council and for running for the Republican presidential nomination back in 2000, offered his take on Democratic U.S. Sen. Bill Nelsons idea of expediting the constitutional challenge launched by Florida against the federal health care law to the Supreme Court of the United States.
Nelson anticipates a favorable decision, and he wants the issue put to rest before he faces the voters next year, noted Bauer --now with the Campaign for Working Families PAC and the Our American Values public policy group --in an e-mail to supporters on Thursday. But why should Nelson expect the Supreme Court to uphold Obamacare? He has hope because there are four left-wing judges on the court, two of whom were appointed by Barack Obama. (Yet another example of how elections have consequences.) The judiciary is just as divided as every other major institution in America -- from our politics to our churches. There are four liberals, four conservatives and one moderate on the court.
For conservatives, the meaning of the Constitution is plain and obvious, continued Bauer. But for liberals, the Constitution is a living document subject to changing interpretations that best fit their desired political outcomes at any given time. No matter how mortified the Founding Fathers would be, the same justices who routinely find a right to abortion in the Constitution will likely have no difficulty finding a right for the government to run our health care and dictate how you spend your money.
And given how deeply divided the country is today, this case is a good example of why moderation is not always the best answer, added Bauer. Ultimately, this decision, which affects hundreds of millions of Americans, may rest with just one man -- the moderate Justice Anthony Kennedy. We have no idea what he may do.
