Marco Rubio Brings Back 'Red Flag' Bill for New Congress

On the first day of the new Congress, U.S. Sen. Marco Rubio, R-Fla., brought back the “Extreme Risk Protection Order and Violence Prevention Act.”

On Thursday, Rubio paired up with Republican U.S. Sen. Susan Collins and independent U.S. Sen. Angus King of Maine and U.S. Sen. Jack Reed, D-RI, to reintroduce the bill which “will dedicate Department of Justice funds to incentivize states to give law enforcement the authority to prevent individuals who pose a threat to themselves or others the ability to purchase or possess firearms, while still providing due process protections.”

Rubio first unveiled the bill in March after the Parkland shooting. When he showcased the bill on Thursday, Rubio said his proposal will help protect students. 

“A gun violence restraining order is one of the most effective policies we can put in place to prevent another tragedy like Parkland,” Rubio said. “We can help keep our schools and communities safe by empowering law enforcement or family members to use the judicial system to keep guns out of the hands of dangerous individuals. This idea has already proven successful in states like Florida, and it is my hope that this bill will get other states to do the same thing.”

“Our schools and many other public places are too often the targets of gun violence. We have a duty to do more to prevent this kind of violence. This bipartisan bill gives law enforcement and concerned family members a way to petition state and tribal courts to keep guns away from people who have exhibited serious, documented signs of danger and violence to themselves or others,” said Reed. “Red and blue states alike have been out front on this issue, adopting so-called ‘Red Flag’ laws. Our bipartisan initiative builds on these state solutions that already exist in states like Florida and Rhode Island, and provides incentives to effectively run and improve these important state efforts. It doesn’t force states to act, but encourages states that do. We must come together and do more to prevent gun violence, and passing this bipartisan bill would be a major step in the right direction.”

“Too many families, in too many communities across America, have felt the pain of losing a loved one to gun violence,” said King. “Far too often, we learn after the fact that many tragic mass shootings were committed by individuals who displayed warning signs of emotional or mental distress, and were still able to purchase a gun. These horrific losses could have possibly been prevented -- but they weren’t, and that’s simply unacceptable. This isn’t about infringing upon the Second Amendment rights of law-abiding gun-owners – it’s about using due process to pursue a proactive approach to save lives by intervening early with those who have shown significant danger to harm themselves or others.”

“Gun violence is a problem that affects far too many communities across the country,” said Collins. “Family members and law enforcement officers are often in the best position to identify when someone poses an immediate threat to themselves or others, but in many cases they are unable to intervene before it is too late. Our bipartisan legislation would provide a way for them to temporarily prevent dangerous individuals from possessing firearms. Several states already have ‘red flag’ laws, which enhance gun safety while retaining important due process protections and preserving the Second Amendment rights of law-abiding citizens.”

Not very smart Rubio... Criminals are still going to have guns, acquired through illegal channels. This law will do nothing but put more, unnecessary regulations on Law Abiding United States Citizens. Your inside the box Pelosi-esque, double speak rhetoric in support of this bill smacks of the same propaganda that Hitler and Stalin spewed to the masses. This bill puts a "red flag" up for me, about you Paul Rubio... As in not to trust a word that comes out of your mouth. You, Pelosi and Schumer should get a room and stay there. Amen to those comments on Rubio and others concerning gun regulations. Guns DO NOT kill people, People kill people. In my Military Experience and a Combat Veteran, there are many ways that i know of to kill a human being. Hardware Stores are full of Weapons of Mass Destruction. If you take the gun out of the equation from the school shooting, would all of those kids be dead?

It appears that the deranged gun loving haters and mental creeps are upset that you are finally doing something right. I can’t understand how anyone would object to keeping guns out of the hands of dangerous, mentally ill people, unless that describes them. It’s just good common sense.

No one is objecting to keeping guns out of the hands of dangerous or mentally ill people. That's pure bs misrepresention. They're objecting to the denial of due process before the confiscation of property and denial of liberty of someone who has not been proven to be dangerous or mentally ill. I guess you are either ignorant or dont even care what due process is. I'm leaning towards the latter.

There lies the problem. Sure it makes sense to keep guns out of the hands of dangerous, mentally ill people. However, who gets to decide who is mentally ill or dangerous and what exactly is going to qualify as such? A family doctor stating you're dangerous because you're stressed? A police officer turning you in because you were speeding and upset about getting a ticket? All it takes is a finger pointed. If you think for one second honest, law abiding citizens wont be be victims of such laws, think again.

According to the proposed law .......anyone accusing anyone....... of being a "hater" or a "gun lover" is exhibiting signs of mental instability and a verbally violent disposition and therefor...... can be restricted on their right to speak out against their perceived "enemies".

I assume you don't care to own a gun. Perhaps you would feel differently if this were a law to allow to take your automobile away from you if a neighbor reported you as a dangerous driver? If this law passes and applies to me, I will push to get a law passed to do just that.

No one is trying to take anyone's guns away except from those who are a blatant risk to the neighborhood/town based on evidence and common sense. If you're not one of those gun owners, then you have nothing to worry about.

Rubio the boobio still doesn't get it. The primary problem with this nationwide hysteria to enforce red flag laws is none are crafted with sufficient protections for the accused. Apparently, we've been deluding ourselves that the U.S. judiciary would rather let ten guilty parties go free than convict one innocent person. Additionally, these laws generally place enormous responsibility and pressure on police officers and judges to dispense pretrial punishment, just in case. This kind of punishment is overly severe to be based on amateur opinions. Since we're dealing with mentally troubled persons, the law should include analysis by licensed psychiatrists. Doubtlessly, we all know of judges and law officers who are far from qualified for such professional undertakings. I also doubt that they'd volunteer to diagnose mental illness if their jobs depended on doing it correctly. This movement makes it clear that democrats want control without responsibility. I used to wonder why leftists saturate media outlets with soothing pleas for conversation instead of acting on their clear and ultimate goal of total confiscation. I assumed they stopped short of the extreme because they know firearms owners won't tolerate confiscation without unimaginable fury. Fact is leftists will temporarily settle for controlling little things like angry partners, bayonet lugs, ammunition taxes, bullet shapes and so on. It’s part of a common leftist flimflam. Eventually they'll again get around to universal background checks that are impossible to regulate without universal registration. They need universal registration because it fundamentally transforms 120 million owners into dependents. Once they know who the owners are, they’ll choose which of them are allowed to be licensed. It’s the consummate entitlement. The democrat party cannot survive without more than half the nation being dependent on the government. Leftists trade entitlements for votes. It's the heart of their strategy. Seems the accused would be afforded at least a modicum of professional analysis and an official opinion by two or more psychiatrists. Leftists screech in the streets if denied a full measure of due process but close their eyes on the subject of self-defense by firearm. These laws open the doors to scorned partners, angry neighbors, children seeking a parent's wealth and arrogant judges. They empower mothers, fathers, brothers, sisters, sons, daughters, uncles, aunts, cousins, friends, neighbors, judges, police officers, boyfriends, girlfriends and everyone except those actually qualified to judge mental competence. Makes me wonder about the motive for this law. The Diagnostic and Statistical Manual of Mental Disorders lists nicotine dependence, aka smoking, as a treatable disorder. I'm sure socialists already are piecing together another version of this law to declare smoking as sufficiently deranged behavior to justify confiscation of firearms. To iterate, socialists are not interested in public safety. They hope to disarm the governed before dispatching the disobedient.

This is exactly my thoughts on this stuff. Leftists don't want total gun control because they know that will never happen. They only want a little - today. A little more - tomorrow. Just an added couple of questions on the background check - the next day. Eventually the 2nd Amendment is gone and full gun control has been established. Now that the population can't defend themselves against armed thugs they are totally dependent on government for defense (haha), and since they are defenseless against the government, there go the rest of your rights. What are you going to do about it? Kick your feet and throw a tantrum in the street like a good little brainwashed leftist? No need, they will already be in control and just label you as mentally unfit to be in society and lock you up - at least until they decide to start euthanasia.

I thought most states already have option of involuntary commitment if, based on mental issues someone is a threat to themselves or others. If it is not a mental condition, there is no basis for legal action for "precrimes". I may yell at my neighbor for their dog dumping in my yard, when does their "fear" justify a legal action against me?? Because if family can "fear" you for a disagreement, that scenario isn't far behind.

We already have laws to prevent that Marco Rubio this bill violates all Americans constitutional rights about due process and the 2 amendment and is just and attack on our civil liberties as United States citizen.
