John Morgan: I'll Sue for Smokeable Marijuana, and I'll Win

John Morgan says it’s a patient’s right to be able to smoke marijuana.

So fervent is Morgan in his belief that he is prepared to sue Florida over the state’s newest medical marijuana regulations, which prohibit smoking the drug outright.

On Wednesday Gov. Rick Scott said he would “absolutely” sign the Florida legislature’s proposal to regulate the state’s booming medical marijuana industry, which is only set to expand as time goes on.
 
"They worked hard to get a bill that made sense,” Scott said. “I think, in anything like this, there's a process on how to make things better.”
 
It didn’t take long for Morgan to respond, saying he was ready to head to court as soon as Scott’s signature hit the bill.
 
“Great Scott!! I'll be filing my lawsuit for smoke as soon as it goes into law,” he wrote on Twitter
 
The current proposal to regulate medical marijuana allows patients to ingest the drug via edibles, oils or vaping, but prohibits smoking the drug -- an issue that has pro-medical marijuana advocates up in arms. 
 
Morgan says state lawmakers didn’t quite understand the intent of Amendment 2, which he largely crafted with other pro-medical marijuana advocates.
 
“I don’t know what their problem is with smoke but that’s clearly the intent of the amendment,” Morgan said.  “I will get to sue them to allow medical marijuana to be smoked.”
 
Morgan told Sunshine State News Amendment 2 restricts patients from smoking the drug in public, but said the underlying implication is that medical marijuana can be smoked in the privacy of patients’ homes.  
 
The firebrand attorney is confident he will emerge victorious.
 
“The reason I will win is because the amendment says clearly that medical marijuana may not be smoked in public, but if it may not be smoked in public it may be smoked in private,” he said.
 
The Orlando attorney said he believed lawmakers feared marijuana, with the ban on smoking being just another way to voice their disapproval over the alternative medication.

“They’re making it a health issue like someone in chemotherapy is taking a few tokes,” Morgan said. “It’s a bunch of people who don't understand what they don't understand. When you're dying the last thing you care about is the smoke from marijuana."
 
Other medical marijuana advocates agreed.
 
“I think it’s silly that the legislature insists on banning the single most common method of consumption of marijuana,” Florida For Care executive director Ben Pollara told SSN. “It’s also contrary to the definition of ‘marijuana’ and ‘medical use’ in the Florida Constitution.
 
Morgan told SSN he had already started preparing the lawsuit, enlisting former Florida politician and fellow attorney Jon Mills to help him snag a win for smokeable marijuana. 
 
Morgan said he plans on filing the lawsuit when Scott signs it into law. The governor officially received the bill Monday and has two weeks to sign the bill.

Yes alcohol was I said WAS illegal. Now people drink which I couldn't care to each their own. Laura knows about prohibition of alcohol back in the days. Alcohol kills cannabis doesn't and a fact is that it helps people with many medical issues. I am one of them. I started marijuana for my PTSD 2 years ago now. I have my license but I totally agree prohibition of the marijuana plant is basically about money and that's it. My ex, a very successful educated ex owner of a verrry successful pharmacy in Fort lauderdale, FL who retired at the age of 37 because pills are very expensive and became rich very fast was the one who told me to try marijuana. I was adamant at first but I did and now Im saved. I thank him and let's get it totally legal like a fkn cigarette. That's my experience.

While he is doing this, he needs to include some protections for those who can legally use cannabis. Leases are now saying NO Medical Marijuana in them, Doctors are firing patients if they get a MMJ card, Pain management DOC are firing patients left and right over using a legal substance. There is nothing worse than being extremely ill and the feeling of being very euphoric from OxyContin, Lortabs, Vicodin, etc.... sick people can take two small draws of a vaporizer (not pen type) or a small pipe and all the sudden have no pain, increased appetite and relief. If you have never been that sick, if you have never suffered the severe side effects from prescription drugs, then you seriously need to use google more. The information is endless. Sick people don't want to be so high/euphoric from drugs...they want to feel good, normal and enjoy life the best they can. So happy the VA is now recognizing and allowing Veterans to smoke for PTSD.... read up old Vets... were going to take your scotch away and let you put that in your pipe and smoke it .... pun ;)

as a vet...I can tell you that the va is pro marijuana...but being a federal entity cannot and will not at this time condone its use...it cant because at the federal level it is still against the law...doesn't matter what state the va is in even if it is 100 percent legal in that state the va cannot provide marijuana...I wish what you say is true but sadly it is not...but your attitude toward it does show that most americans are for medical marijuana...and that is the start to making the change that can so dramatically help so many people : )

I support John and legalize it 100% is exactly what should be done to try and tell grown up people they can drink all the liquors they want but if you have a small amount of pot your going to go to jail is not only wrong there should be a class action lawsuit and we should all sue them! Realize this, after all the riga marole and expenses to e able to get that first script, it is still $190 a week, so the average Joe or Mary won't be able to access anyway, and insurance will not cover it, so only the privileged few will have access. And that is a crime, withholding viable medication, due you the worship of the dollar, can you say medical neglect? Scott's pockets are not for the people.

I've read a lot of comments here about how bad John Morgan is and I'm just wondering who else is going to make the smokeable thing happen. I haven't read or heard from anyone else coming forward that will get this done and all you smart people on here slamming everything sure aren't helping either. It's not going to just happen on it's own so why don't some of you smart people just get it done then and not worry about what John's doing. I thought 'we already did that with the passing of amendment 2 to our constitution. I cannot imagine that 71% of the voters (not sure how many million) voted for medical cannabis and understood that smoking was the primary way of delivery. It is difficult for me to understand the mind set of a person who has clung to a myth about cannabis that is nearly a century old. It is time that the people of Florida come of age.

Such bullshit, Rick Scott will not make the so called flower available because he has only allowed certain people to have license to grow and sell it, i dont imagine that he would be making a big kickback if people could buy the flower, from somewhere other than the state, the state would loose too many customers, it's a monopoly, I'm sure.

5 people 5:rich people with big money behind them are the only ones licensed to grow in the state of Fla It's a big money maker for the already rich I checked into it . Its a $300.00 deposit to be put on a 3 month waiting list , afterwards there's another @$275.00 deposit Followed by a phone interview with a Dr that will determine over the phone if you're able to buy medical marijuana . It's likely that everyone that spends the money will be approved and there is a $75.00 fee for renewed prescriptions plus the cost of the product They are now legalized pot dealers . I'll stick to getting my oils from the ones I've been getting it from for the last 2 yrs I've always said when big pharma and big money could control the profits from pot that it would become leagal That time has Come
